1. Booking and Payment Terms

  • Deposit: An 80% non-refundable deposit of the total quoted price is required to secure all bookings and allow materials to be ordered and labour allocated.
  • Balance Payment: The remaining 20% is due on the day of installation, prior to commissioning, programming or handover.
  • Right to Request Full Payment: Gate Repairer Ltd may require full payment upfront for bespoke, specialist or high-value work at its sole discretion.
  • Payment Methods: BACS transfer, debit/credit card, or cash.
  • Ownership of Goods: All materials, components and equipment remain the property of Gate Repairer Ltd until payment is made in full. Where legally permissible and without trespass, Gate Repairer Ltd may recover and remove its goods in cases of non-payment.
  • Non-Payment: Failure to pay any invoice by the due date may result in suspension/cancellation of works, refusal to commission/handover, withdrawal of warranty, recovery of goods (where lawful), late payment interest and recovery costs.
  • No Set-Off or Withholding: The client may not withhold, offset, delay or deduct any payment for any reason.

2. Cancellations and Amendments

  • Cooling-Off Period: You may cancel within 14 days of booking, provided no bespoke items have been ordered and work has not commenced.
  • Cancellations After 14 Days: May incur charges for materials, labour, administration and restocking.
  • Amendments: Any change to the agreed work must be made in writing and may incur additional charges and revised timescales.
  • Timescales: All attendance and completion dates are estimates only and may change due to weather, access, supply problems or third-party delays.

3. Guarantees and Warranties

  • Manufacturer’s Guarantee: All products supplied include the relevant manufacturer’s guarantee. Terms vary by brand/component.
  • Workmanship Warranty: Gate Repairer Ltd provides a 12-month workmanship warranty from the date of installation.
  • Extended Warranty: May be offered at our discretion and only when the client enters an appropriate service and maintenance plan. Failure to service as required voids extended warranty.

4. Warranty Exclusions

Consumables / items not covered Batteries, lights, signs, remote controls/fobs, wireless safety-edge transmitters/receivers, photocells/safety sensors, wireless devices, LEDs, bulbs, keys, covers, seals, fixings.
Misuse, abuse or neglect Forcing gates, climbing/leaning, allowing gates to slam in wind, obstructions in gate path, failure to secure manual releases, vandalism.
Third-party interference Any works/adjustments by anyone other than Gate Repairer Ltd or approved contractors voids warranty immediately.
Environmental / external causes Flooding/water ingress, storms/extreme weather, power surges, structural movement/subsidence, animal damage, vandalism, fire.
Cosmetic wear such as fading, minor corrosion and aesthetic deterioration over time is not covered.

5. Immediate Warranty Void (Automatic and Irrevocable)

  • Forced gates: If gates are pushed/pulled/forced, obstructed, climbed on or misused, warranty is void immediately.
  • Third-party interference: Warranty is void if any third party touches/adjusts/tests/accesses/interferes with motors, boards, programming, wiring, junction boxes, hinges/brackets, safety devices or manual release.
  • Customer interference: Warranty is void if the customer accesses or adjusts settings, wiring, safety systems, components or fixings without written permission.
  • Unapproved accessories: Connecting unapproved transmitters/receivers/intercoms/CCTV/control devices voids the warranty.
  • Failure to maintain: Warranty is void if the system is not serviced regularly as required.

6. Effect of Warranty Void – No Liability or Claims Accepted

  • No liability: Gate Repairer Ltd is released from all liability, duties and obligations.
  • No claims accepted: No claims for repairs, replacements, goodwill work or compensation will be accepted.
  • No contribution: No reimbursement will be made towards third-party costs or assessments.
  • All future attendance chargeable: Labour, parts, travel, diagnostics and call-outs become chargeable at standard rates.
  • No reinstatement: A voided warranty cannot be reinstated under any circumstances.
Client acknowledgement: The client acknowledges that once the warranty is voided, all claims and remedies are permanently extinguished.

7. Client Responsibilities and Duty of Care

The client becomes the duty holder upon handover and must:

  • Keep the system free from interference.
  • Prevent unqualified persons accessing equipment.
  • Report issues immediately.
  • Prevent unsafe operation.
  • Maintain a clear gate path.
  • Keep vegetation and debris clear.
  • Ensure children do not operate the system.

8. Site Preparation and Access

  • Provide clear, safe access for engineers and vehicles.
  • Remove vehicles, bins, debris and vegetation where required.
  • Disclose underground services and site hazards.
  • Ensure posts, walls and structures are suitable for automation.
Additional labour/materials caused by access restrictions or unforeseen site issues may be charged.

9. Servicing and Maintenance

  • Routine maintenance: Client must keep installation free from debris/obstruction and perform basic checks.
  • Service plans: Plans may include inspections, adjustments, lubrication and testing. Unless stated otherwise, parts/repairs/emergency call-outs are chargeable.
  • Extended warranty: Failure to service appropriately may void extended warranties.

10. Limitation of Claims Period

Any claims relating to workmanship or installation must be raised within 30 days of the issue first being observed. Claims raised outside this period will not be accepted.

11. Indemnity

The client shall indemnify and hold harmless Gate Repairer Ltd against all losses, costs, claims, liabilities, damages, charges or expenses arising from misuse, interference, third-party damage, failure to follow instructions, negligence, continued use of a faulty/unsafe system, or any breach of these Terms.

12. Liability

  • Gate Repairer Ltd is not liable for misuse/negligence, third-party work, environmental damage, structural defects in existing gates/posts, or indirect/consequential loss.
  • Total liability is limited to the total amount paid for the relevant works.
  • Nothing excludes liability for death or personal injury caused by negligence.

13. Data Protection

We comply with relevant UK data protection law. Personal data is used only for service delivery and administration.

14. Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties. No verbal statements or representations override this document.

15. Survival Clause

All clauses relating to payment, warranty, liability, indemnity, warranty void effects, governing law and dispute resolution survive termination.

16. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

17. Additional Commercial and Technical Terms

17.1 Quotations Quotes are typically valid for 14–30 days. Scope is limited strictly to items listed. Changes in site conditions may affect pricing.
17.2 Variations Additional works discovered on site are chargeable and must be approved before proceeding. Where urgent safety issues exist, we may recommend immediate action.
17.3 Call-outs & Access Missed appointments or refused access may be chargeable (travel + time), especially where slots are reserved or booked in advance.
17.4 Power & Networking Client is responsible for stable power supply and, where smart/app features are used, suitable WiFi/4G coverage unless included in scope.
17.5 Groundworks / Civils Unless quoted, digging, reinstatement, ducting and making-good are excluded.
17.6 Existing equipment Work on legacy/unknown systems may reveal pre-existing faults. We cannot warrant pre-existing defects.
17.7 Safety devices If site constraints prevent full compliance without extra works, we will advise and may refuse commissioning until made safe.
17.8 Force testing Where testing is requested/required, results apply at time of test only. Changes in hinges, ground movement or wear may affect compliance later.
17.9 Photographs & records We may take site photos for job records, compliance and warranty evidence. Photos are not used for marketing without consent.
17.10 Chargebacks Card chargebacks raised without giving reasonable opportunity to resolve may be treated as non-payment.
